Terms of service

In the event of any discrepancy between language versions, the English version of these Terms and Conditions shall prevail. LAR (“Company”) and its associated domains are owned and operated by SHIMMERINGHILL UNIPESSOAL, LDA, with registered office at Largo dos Marquinhos 4, 1esq, 2655-448 Ericeira, corporate tax number 518962318. These Terms and Conditions govern access to and use of the website www.lar-home.com (“Website”), online store and any other contracts or transactions carried out through it.

By making a purchase or using our communication channels, the client (“Client”, “User”) acknowledges and fully accepts this document, without prejudice to mandatory consumer rights provided for under Portuguese law.

These Terms and Conditions are complemented by, and shall be read in conjunction with the Privacy Policy  available on the Website.

1. Activities of LAR

LAR is engaged in the design, marketing, and retail of home textile products and home-related goods, primarily through its online store. Additional activities may be carried out on a temporary or complementary basis, provided they comply with applicable law and are duly communicated to clients.

2. Use of the Website

The Website may only be used for lawful purposes and in a lawful manner.

By using the Website, the User agrees to:

  • Comply with all applicable laws, statutes, and regulations relating to the Website and its use;

  • Comply with all general and specific conditions governing the Website and any transactions or contracts concluded through it;

  • Use the Website solely to make legitimate inquiries or place legitimate orders;

  • Complete all electronic forms accurately, completely, and truthfully — including registration and order forms — and consent to the use of the information provided so that LAR may contact the User where necessary, in accordance with the Privacy Policy.

3. Prohibited Use

The User must not:

  • Upload or transmit viruses, Trojans, worms, logic bombs, or any other material intended to interfere with, damage, or disrupt the normal operation of any computer system;

  • Use the Website or any of its forms or platforms to distribute illegal, unlawful, harmful, or offensive content, or content that violates applicable law, ethics, or public order;

  • Attempt unauthorized access to the Website, the server on which it is hosted, or any connected server, computer, or database.

Any breach of this section may constitute a criminal offence under applicable law. LAR reserves the right to report such violations to the competent authorities and to cooperate fully by disclosing the User’s identity where required.

In the event of a breach, the User’s right to access and use the Website will be terminated immediately, without prejudice to any other rights or remedies available to LAR.

4. Payments

To make purchases through the Website, Users must complete payment in the applicable currency. Before finalising any transaction, Users will be able to review and expressly accept the total amount payable, including any applicable taxes and fees.

4.1. Payment Systems

All payments made by Clients to LAR are processed through secure online payment systems operated by third-party payment providers, including Apple Pay, Google Pay, Shop Pay, and PayPal. By using these payment methods, the Client also agrees to the terms and conditions of the relevant payment provider. Available payment options may vary depending on the Client’s location, device, or browser.

5. Product Purchases

Products sold by LAR are offered exclusively through the online store at www.lar-home.com.

5.1. Product Availability

All stock indications and delivery times are provided for information purposes only.

If stock shortages or processing delays prevent delivery within the indicated timeframe (plus an additional 5–10 business days), LAR will inform the Client. The Client may then choose to accept a revised delivery date or cancel the order and receive a full refund.

LAR reserves the right, but not the obligation, to limit the sale of products to specific persons, regions, or jurisdictions. If a product becomes unavailable after an order has been placed, LAR will notify the Client and may propose an alternative product or cancel the order, in whole or in part, with a refund of the corresponding amount.

5.2. Prices and Promotions

All prices are displayed in euros or, where applicable, in local currencies, and include VAT. Promotions, offers, and discount codes cannot be combined unless expressly stated otherwise.

5.3. Errors and Omissions

While LAR makes every effort to ensure accuracy, errors or inaccuracies may occasionally occur, including in product descriptions, prices, promotions, shipping costs, or availability.

LAR reserves the right to correct such errors, update information, or cancel orders where inaccuracies are identified, even after an order has been submitted, without prior notice.

If a pricing error is identified before dispatch, LAR is not obliged to supply the product at the incorrect price, even if an order confirmation has been issued. 

In such cases, the Client will be informed and may choose to:

  • Proceed with the order at the correct price, paying any applicable difference;

  • Receive a refund of the difference if the displayed price was higher; or

  • Cancel the order and receive a full refund.

If LAR is unable to contact the Client, the order will be cancelled and fully refunded.

5.4. Transfer of Risk, Ownership, and Personal Use Disclaimer

The risk of loss or damage to products passes to the Client upon delivery. Ownership of the products transfers to the Client only once full payment, including any applicable shipping costs, has been received by LAR.

Upon delivery, the Client must inspect the packaging and products to ensure they are intact and correspond to the order. If the packaging is visibly damaged or the products are incorrect, the Client must follow the instructions provided by LAR.

Products sold by LAR are intended for general household use. While LAR ensures that materials comply with applicable safety and quality standards, the Client acknowledges that some individuals may experience allergic reactions, skin irritation, or other personal sensitivities. The Client assumes responsibility for assessing their own suitability for use of the products. LAR shall not be liable for any allergic reaction, irritation, or other personal sensitivity resulting from normal use of the products, except where mandatory law provides otherwise.

6. Returns

Clients have the right to withdraw from the purchase and return products within 14 days of receiving their order, without providing any reason, in accordance with applicable consumer protection laws.

To be eligible for a return, products must:

  • Be unused, unwashed, and in their original condition

  • Be returned in the original packaging, including all labels and tags

  • Show no signs of wear, damage, or handling beyond what is necessary to verify the nature and characteristics of the product

To exercise the right of return, Clients must notify LAR of their decision by contacting info@lar-home.com within the 14-day return period. LAR will provide instructions for returning the products.

Unless the return is due to a defective or incorrect item supplied by LAR, return shipping costs shall be borne by the Client.

For hygiene and safety reasons, LAR reserves the right to refuse returns of products that have been used, washed, altered, or are returned without their original packaging and labels.

7. Third-Party Links

The Website may contain links to third-party websites or services for informational or payment purposes. These sites are not controlled or operated by LAR.

LAR does not endorse and cannot be held responsible for the content, privacy practices, or any loss or damage resulting from the use of such external websites. Use of third-party links is at the Client’s own risk.

8. Force Majeure

LAR shall not be held liable or deemed in breach for any failure or delay in performing its contractual obligations caused by force majeure – events beyond its reasonable control that could not have been foreseen or avoided.

Examples of force majeure events include, without limitation:

  • Public disturbances, riots, invasions, terrorist acts or threats, war, or preparations for war;

  • Sabotage, strikes, embargoes, or government orders;

  • Fire, explosion, storm, flood, earthquake, epidemic, or other natural disasters;

  • Disruption or unavailability of public or private transport, communication, or utility systems.

During any period of force majeure, LAR’s obligations shall be suspended, and deadlines or delivery times shall be extended accordingly.

9. Data Processing

All personal information and data provided by the User are processed in accordance with LAR’s Privacy Policy, which is available on the Website.

By using the Website, placing orders, or interacting with LAR’s services, the User consents to the collection, use, and processing of their data as described in the Privacy Policy.

10. Website and Online Store Use

By using the Website or placing orders, the User confirms that they are at least 18 years old and legally capable of entering into binding contracts.

All statements and data transmitted electronically are considered legally valid. The User also confirms that all personal information provided is true, accurate, current, and complete, and that they are not impersonating another person or entity.

The User agrees to:

  • Use the Website solely for legitimate inquiries and orders;

  • Refrain from submitting false, fraudulent, or misleading orders (such orders may be cancelled and reported);

  • Provide accurate contact details and consent to their use for communication purposes in accordance with the Privacy Policy.

11. Intellectual and Industrial Property

The User acknowledges that the Website, including its structure, design, content, functionalities, trademarks, and logos, is owned by or licensed to LAR and is protected by intellectual and industrial property laws.

Users may view content and print copies for personal, non-commercial use only, provided that all copyright and proprietary notices are retained.

No content from the Website may be reproduced, published, transmitted, modified, sold, or distributed without the prior written consent of LAR. The display of trademarks or logos on the Website does not grant any rights to use them.

Any other use of the Website’s content without prior express consent may constitute a violation of national and international laws.

12. Entire Agreement

These Terms and Conditions constitute the entire agreement between LAR and the User regarding the use of the Website and supersede any prior verbal or written agreements or understandings.

13. No Waiver

Failure by LAR to enforce any provision of these Terms shall not constitute a waiver of that or any other right. No waiver is valid unless it is expressly stated in writing and communicated to the Client.

14. Validity

If any provision of these Terms and Conditions is found to be unenforceable or contrary to law, the remaining provisions shall remain valid and in full effect.

15. Governing Law

These Terms and Conditions, and all purchases, contracts, or transactions made through the Website or online store, are governed by Portuguese law.

16. Consumer Dispute Resolution

In the event of a dispute, the Client may resort to Alternative Dispute Resolution (ADR) mechanisms – mediation, conciliation, or arbitration – as provided in Law No. 144/2015, of 8 September. A list of approved ADR entities is available on the Portuguese Consumer Portal (www.consumidor.gov.pt)
